NOTES FROM THE OFFICE
1. If a party becomes dissatisfied with the mediation or mediator PLEASE refer them to the trial coordinator to assign a new mediator. No one gets along with everyone and it is far better to reassign a mediator than to handle a complaint.
2. Please remember that when we have the judicial round tables, not to ask the judge mediation questions. He is there to discuss legal terms, procedures, issues and decisions. Save those questions till before or after the judge is present.

AT THE ROSENTHE DRC CONFERNCE IS A GREAT SOURCE FOR CME AND NETWORKING! Those who have signed up must submit a check for $55.00 made out to Orange County on or before August 1, 2001.

If you have signed up for the RSVP thank you luncheon, please let me know so that we can reserve a table.
SEPTEMBER 12 (WEDNESDAY) AT NOON - NEXT ROUNDTABLE
We will try to send notes on what we discuss. CME credits for roundtable sessions. Bring a lunch BUT WAIT UNTIL THE ROUNDTABLE BEGINS TO EAT. The judges feel uncomfortable being the only one eating.
OCTOBER 10-13TH - SPIDR CONFERENCE IN TORONTO
Anyone who can make the annual conference for some REAL networking can review the brochure in my office.
NOVEMBER 2, FRIDAY - MEDIATION DAY - IN THE JURY ROOM
Cake walks, cooking contests, talent contests, what’s my line contest etc. Come have fun with us.
Questions and notes from the July ROUNDTABLE (thanks to Ealnor)
1. If a case is settled in mediation and the plaintiff has not requested court costs, you should not subtract the court costs from the principal to complete the agreement. Depending on what the parties want, put 0 or n/a.
2. If court costs have not been mentioned, the mediator does not have to bring them up. However, please remember that when you read the stipulation, court costs are on there and have to have 0 n/a or an amount depending on what the parties want.
3. Can either party make a telephone call during mediation in reference to anything about the case?
Yes, if all parties agree. You do not need to police the parties so if they don’t ask you, and you see them on the phone during caucus, it is not your responsibility. The DRC Resolution Report covers the issue of phone calls etc. during mediation.
4. Do you have to ask about settlement authority? No
5. If a mediator must leave the room and is concerned or anxious about leaving the parties in the room what can he/she do?
Separate the parties or call the front desk from your phone.
